New rules for the cancellation of temporary visas and permits: what has changed and what to prepare for?

As of January 31, 2025, new regulations have come into effect in Canada, strengthening control over temporary residents. Immigration and border services now have clear authority to cancel visas and permits in several cases.

Which Documents Can Be Canceled?

The following documents may now be subject to cancellation:
  • Temporary Resident Visas (TRV)
  • Electronic Travel Authorizations (eTA)
  • Work Permits
  • Study Permits

When Can Documents Be Canceled?

Authorities may now revoke a document if:
  • The individual becomes inadmissible due to changed circumstances (e.g., providing false information, acquiring a criminal record, or passing away).
  • An officer doubts that the applicant will leave Canada at the end of their authorized stay.
  • The document is lost, stolen, destroyed, or voluntarily surrendered by the applicant.
  • The person becomes a permanent resident, but their temporary documents remain active.
  • The document was issued due to an administrative error.

Why Is Canada Tightening Control?

This is part of a broader trend towards stricter immigration policies. In recent years, Canada has seen an increase in overstayed statuses and cases of misuse of temporary programs. Now, officers have explicit powers not only to refuse visas but also to revoke them if circumstances change.

What Should Applicants Do?

If you already hold temporary status in Canada or are applying, it is important to:

✔ Follow the conditions of your stay and do not overstay your authorized period.
✔ Promptly update your information if your circumstances change.
